TERMS OF SERVICE

1. Agreement to Terms

By accessing or using any services provided by Krafti Media Marketing LLC ("Company," "we," "our," or "us"), you ("Client," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms please do not use our services.

2. Services

Krafti Media Marketing LLC provides digital marketing automation services including but not limited to:


Missed call text-back systems

Automated SMS follow-up sequences

Appointment reminder automation

AI review request systems

AI chat assistant setup

Customer follow-up sequences

CRM pipeline setup and management

Performance reporting and analytics

System monitoring and maintenance

3. Service Packages

Starter Package


One-time onboarding fee: $499

Monthly maintenance fee/subscription: $99/month

Includes: Missed Call Text-Back, Automatic SMS Follow-Up, Monthly Check-In Call, Email Support, System Monitoring, Monthly Performance Report


Growth Package


One-time onboarding fee: $499

Monthly maintenance fee/subscription: $299/month

Includes: Everything in Starter plus Customer Follow-Up Sequence, Appointment Reminders, AI Review Request System, Bi-weekly Optimization, Bi-weekly Performance Report


Pro Package


One-time onboarding fee: $499

Monthly maintenance fee/subscription: $699/month

Includes: Everything in Growth plus Priority Support, AI Chat Assistant, Full CRM Setup, Weekly Performance Reports, Priority Response within 2 hours

4. Payment Terms

One-Time Onboarding Fee


The one-time onboarding fee of $499 is due before work begins

The onboarding fee covers the cost of building and installing your custom automation system

System setup and installation will be completed within 48 hours of receiving payment and all required business information

Full SMS automation functionality will be active within 3-5 business days pending carrier approval of A2P 10DLC registration

The one-time onboarding fee is strictly non-refundable under any circumstances once work has commenced


Monthly Maintenance Fee/Subscription


Monthly maintenance fee/subscription is billed automatically on the same date each month

First month maintenance fee/subscription payment is due at the time of onboarding

All payments are processed securely through our payment processor

Funds are deposited into Krafti Media Marketing LLC's business account


Late Payments


If payment fails we will attempt to charge your card 3 times

If payment continues to fail your services will be suspended

A $25 reactivation fee applies to reinstate suspended accounts


Price Changes


We reserve the right to change pricing with 30 days written notice

Existing clients will be notified via email before any price changes take effect

5. Refund Policy

One-Time Onboarding Fee — Non-Refundable


The $499 one-time onboarding fee is strictly non-refundable

This fee covers time, labor and resources used to build your automation system

No exceptions will be made regardless of circumstances


Monthly Maintenance Fee/Subscription — No Partial Refunds


Monthly maintenance fee/subscription is non-refundable once charged

Cancellation takes effect at the end of the current billing period

No partial refunds will be issued for unused days in a billing period

6. Cancellation Policy

How to Cancel


Client may cancel monthly maintenance fee/subscription at any time

Cancellation request must be submitted via email to [email protected]

Include your business name and reason for cancellation

Allow 5 business days to process cancellation


Effect of Cancellation


Cancellation takes effect at the end of the current billing period

No further charges will be made after cancellation is processed

Access to automation systems will be terminated at end of billing period

Assigned phone number purchased for your account will be released after 30 days

Krafti Media Marketing LLC retains the right to keep all system configurations built


Re-activation


Clients who cancel and wish to restart services will be charged a new one-time onboarding fee of $499

7. Client Responsibilities

As a client you agree to:


Provide accurate and complete business information

Update your business phone number on your website and all listings to the assigned number provided

Respond to our communications within a reasonable timeframe

Notify us of any changes to your business that may affect the automation system

Ensure your Google Business Profile is accessible for review management

Comply with all applicable laws regarding SMS marketing and communications

8. SMS Compliance

By using our services you agree to comply with all applicable SMS regulations including the Telephone Consumer Protection Act (TCPA)

All automated messages include opt-out instructions (Reply STOP)

Client is responsible for ensuring their customers have consented to receive SMS communications

Krafti Media Marketing LLC is not liable for any TCPA violations resulting from client's use of our services

9. A2P 10DLC Registration

SMS messaging requires A2P 10DLC registration with carriers before automated text messages can be sent

Each client account requires its own individual campaign registration

Krafti Media Marketing LLC will handle the entire registration process on your behalf

Registration approval is subject to carrier review and is not guaranteed by Krafti Media Marketing LLC

Approval may take 3-5 business days after submission

SMS functionality will be limited until registration is fully approved by carriers

Krafti Media Marketing LLC will notify you once your registration has been approved

A2P registration fees are included in your one-time onboarding fee at no additional cost to you

Ongoing monthly carrier fees associated with SMS campaign maintenance are included in your monthly maintenance fee/subscription

If registration is rejected due to inaccurate business information provided by the client a resubmission fee of $49.50 will be charged. This covers the carrier resubmission fee of $24.50 and a $25.00 administrative processing fee payable to Krafti Media Marketing LLC

Krafti Media Marketing LLC is not liable for delays or rejections caused by carrier review processes

10. Assigned Phone Numbers

Assigned phone numbers purchased for client accounts remain the property of Krafti Media Marketing LLC

Upon cancellation the assigned phone number will be released after 30 days

Clients wishing to transfer their assigned number to another provider must submit a port-out request to [email protected] before their cancellation date

A $25 port-out processing fee payable to Krafti Media Marketing LLC applies to all number transfers

Additional carrier fees charged by the receiving provider are the responsibility of the client

Port-out requests must be submitted at least 5 business days before cancellation takes effect

Krafti Media Marketing LLC is not responsible for any delays caused by the receiving provider during the transfer process

If no port-out request is received within 30 days of cancellation the number will be permanently released and cannot be recovered

11. Performance and Results

Krafti Media Marketing LLC makes no guarantees regarding specific results

Performance depends on factors including but not limited to: industry, call volume, lead quality, market conditions and client cooperation

Results may vary from client to client

We will make every effort to optimize your system for best performance

12. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the course of our business relationship

Client agrees not to share or disclose the tools, platforms or systems used by Krafti Media Marketing LLC to provide services

Krafti Media Marketing LLC agrees to keep all client business information strictly confidential

13. Intellectual Property

All automation systems, workflows and configurations built by Krafti Media Marketing LLC remain the intellectual property of Krafti Media Marketing LLC

Client is granted a license to use these systems while an active subscriber

Upon cancellation this license terminates

Client may not replicate, resell or redistribute any systems built by Krafti Media Marketing LLC

14. Limitation of Liability

Krafti Media Marketing LLC shall not be liable for any indirect, incidental, special or consequential damages

Our total liability to any client shall not exceed the total amount paid in the most recent 30-day period

We are not liable for service interruptions caused by third-party platforms or telecommunications carriers

15. Third-Party Platforms

Our services rely on third-party platforms and telecommunications providers

We are not responsible for outages, policy changes or service interruptions caused by these platforms

We will make every effort to resolve issues caused by third-party platforms promptly

16. Termination by Krafti Media Marketing LLC

We reserve the right to terminate services immediately and without refund if:


Client violates these Terms of Service

Client uses our services for unlawful purposes

Client engages in abusive or threatening behavior toward our team

Client fails to pay after multiple attempts

Client misrepresents their business or intent

17. Governing Law

These Terms of Service shall be governed by the laws of the Commonwealth of Virginia

Any disputes shall be resolved in the courts of Prince William County, Virginia

Both parties agree to attempt resolution through good faith negotiation before pursuing legal action

18. Dispute Resolution

In the event of a dispute both parties agree to first attempt resolution through direct communication

If unresolved disputes may be submitted to mediation before legal action

Client waives the right to participate in class action lawsuits against Krafti Media Marketing LLC

19. Modifications to Terms

Krafti Media Marketing LLC reserves the right to modify these Terms of Service at any time

Changes will be posted on our website with an updated effective date

Continued use of our services after changes constitutes acceptance of new terms

Clients will be notified of significant changes via email

20. Entire Agreement

These Terms of Service constitute the entire agreement between Krafti Media Marketing LLC and the client

These terms supersede any prior agreements or understandings

Any modifications must be agreed upon in writing by both parties

By purchasing any service from Krafti Media Marketing LLC you acknowledge that you have read, understood and agree to these Terms of Service.
